Carlton Miller

Carlton Miller is Board Certified in Construction Law by The Florida Bar and rated AV Preeminent by Martindale-Hubbell. Carlton focuses his practice on assisting clients with the resolution of complex commercial construction law disputes throughout the United States and beyond. He has successfully represented owners, developers, large general contracting firms, agency and at-risk construction managers, design professionals, and subcontractors, regarding numerous multi-million-dollar claims and disputes. His clients have included mainstays in the ENR Top 100 Design-Build Firms, ENR Top 400 Contractors, and ENR Top 250 International Contractors.
Carlton’s civil engineering background allows him to more fully understand and appreciate many of his clients’ issues, as he works closely with them to tackle a variety of construction-related matters and disputes that have included contract drafting and negotiation, delay, disruption, interference and acceleration, nonpayment, claims preparation, defective and/or deficient work, differing site conditions, design disputes, and performance and payment bond claims, to name a few. He has assisted clients facing these and other issues during the construction of freeways, railroads, iconic bridges, dams, water treatment plants, golf courses, condominium towers, theme parks, historic hotels, and numerous additional world-renowned construction projects. He is experienced with formal and informal dispute resolution and has litigated numerous disputes in various state and federal courts across the United States.
Current/recent work has included, for example, owner representation involving hundreds of millions in competing claims before a dispute resolution board on a nuclear power plant project; successfully defending against one hundred percent of the claims brought by an ENR Top 20 general contractor against a developer client regarding the construction of an upscale assisted living facility in Georgia; and securing a one hundred percent jury verdict award in the Eastern District of Virginia in favor of a site contractor client on a solar farm project.
Carlton’s past work has involved the pursuit of over $100M for unpaid work performed as part of a multi-billion dollar gulf coast energy expansion project; securing a favorable resolution on behalf of a general contractor client in a dispute with the owner and a supplier on a $140M+ LaDOTD highway project; drafting and/or negotiating contracts for a $200M+ Nashville entertainment complex, a $60M+ Florida apartment tower, a $170M+ Florida hotel, and a $200M+ Tennessee hotel; representing/advising international general contractor client on a multi-million dollar claim submission to FDOT for extra work, non-payment, and disruption; litigation regarding multi-million dollar payment dispute on a Florida university construction project; and guiding/advising general contractor client on various issues regarding $1.5B+ megamall/theme park in the mid-Atlantic region; the highly publicized litigation involving the massive C.W. Bill Young Water Reservoir in Tampa, Florida; litigation and arbitration involving historic and luxury hotels in Miami Beach and South Beach, Florida; counsel and litigation concerning numerous world-famous central Florida theme park construction projects (e.g., Expedition Everest at Disney's Animal Kingdom; Soarin' at Epcot; Aquatica (SeaWorld), Harry Potter (Universal Studios); Disney Springs).
