Antony L. Sanacory

Antony (Tony) Sanacory is a partner in Hudson Lambert Parrott’s construction and trial groups, and serves on the firm’s executive committee. Tony has significant experience representing all tiers of construction projects on project planning, risk avoidance strategies, bidding, award and negotiation of construction contracts, as well as resolving claims arising from large, complex projects, including large infrastructure, energy, data center and commercial projects.

Tony also has considerable experience resolving disputes. In dispute resolution, his approach is that the best fight is the one avoided. However, sometimes litigation cannot be avoided, and in those cases, Tony has had considerable success representing clients in trial contexts. Some recent examples include:

Lead trial counsel representing site contractor on solar power plant constructed in James City County, Virginia in Strata Solar v. Fall Line Construction and Arch Insurance (Civil Action Case 4:22-cv-00106 E.D. Virginia. After a nine day trial in the “rocket docket,” the jury entered a verdict in favor of Tony’s client, denying the General Contractor’s $6 million claim and awarding the site contractor $1,850,925.54 (plus attorney’s fees determined later), the exact amount (to the penny) the site contractor was seeking.
Lead trial counsel prosecuting $15 million claim ($12 million subrogated property damage claim) for faulty upgrade to gas-powered turbine generator. Oglethorpe Power Corporation is the owner of the power facility. Oglethorpe Power Corporation and Factory Mutual Insurance Company v. EthosEnergy Power Plant Services, LLC, U.S.D.C., Middle District of Georgia, Civ. Action No. 3:18-CV-00072-CDL. Case resolved after client successfully won ten out of ten pretrial motions.
Co-lead trial counsel representing developer on a flag ship senior living center project in Buckhead neighborhood of Atlanta, Georgia in Village Park Paces, LLC v. Gilbane Building Company, Civil Action File No.: 2021-CV-349234 (Superior Court, Fulton County, GA). After the approximately $100 million project experienced cost overruns, defective work, delays and an ever-distancing completion date, the developer terminated the General Contractor and successfully completed the project with a replacement contractor. The general contractor asserted a lien in excess of $12 million, plus attorney’s fees and sought punitive damages of $7 million. After the parties moved to arbitration by agreement, the Arbitrator agreed with Tony’s client and awarded no damages to the General Contractor, the exact outcome sought by the developer.
Lead counsel representing tree care company in a dispute with its fuel provider over a fuel and equipment purchase agreement in James River Solutions, LLC v. AKA Tree Service, LLC, Case No.: CL22002748-01 (Circuit Court, Hanover County, Virginia). After the tree care company terminated an agreement with its fuel provider for failing to provide the equipment and reliably provide fuel, the provider sued AKA for lost profits of more than $1.2 million. After a three-day bench trial, the Court entered a decision requiring the provider to provide the equipment at the agreed price, but awarded the provider only $36,000 of its $1.2 million claim.
Lead trial counsel representing largest electrical supplier in United States defending $15 million claim of Buy America violations and prosecuting claim for unpaid materials in amounts totaling $2.2 million. Obtained summary judgment, total recovery of principal and attorney’s fees and no liability for client. Graybar v. D & N Electric Co., Inc., Liberty County Superior Court, Civil Action File No. 2012-SV-34.
Lead trial counsel defending former employees against insured claims breach of fiduciary duty and breach of loyalty claims (Ironshore is insurer). Northwest Georgia Paving, Inc. v. Kodiak Excavation and Utilities, LLC et al., Sup.Ct., Gwinnett County, Civil Action File No. 17-A12340-2.
Lead trial counsel defending former owner of electrical contractor against claims of breach of fiduciary duty, fraud and Civil RICO in connection with a sale of the company in Nix v. Carter Bros., Fulton County Business Court, Civil Action File No. 2014-CV-253536. Obtained summary judgment on behalf of client defeating all claims. On summary judgment, the Court ruled completely in favor of Tony’s client, dismissing all of Plaintiff’s claims and awarding Tony’s client attorney’s for having to defend them.
